In this issue, we provide to our clients, member of Chamber of Commerce, and friends up-to-date information and details regarding new regulation announced by the Ministry of Industry which orders specific manufacturers operating factory businesses to report essential information to the relevant authorities. The purpose of this regulation is to preserve the environmental quality, including control and monitor the relevant operating result of the factory whether it complies with the law. This regulation was announced on 28th February 2020 as Ministerial Regulation by the Ministry of Industry having the details as follows:
Ministerial Regulation No. 27 (B.E. 2563) (2020) issued under the Factory Act B.E. 2535 (1992)
As mentioned above, the Ministry of Industry announced the Ministerial Regulation No. 27 (B.E. 2563) (2020) issued under the Factory Act B.E. 2535 (1992)(“Ministerial Regulation”). This Ministerial Regulation has added new regulation into the Ministerial Regulation No. 3(B.E. 2535) (1992) issued under the Factory Act B.E. 2535 (1992) as Clause 7 to regulate the factory having pollutants or chemical substances prescribed by the Industry Minister in the Royal Gazette, whether such pollutants or chemical substances e merges from manufacture, possession or use or from operation of the factory, must provide a report consisting of the specific information as follows:
- Quantity of manufacturing, possessing, and using of pollutants or chemical substances;
- Transportation of pollutants or chemical substances out of the factory;
- Procedures for controlling the release of pollutants or chemical substances;
- Specification of relevant machinery and equipment;
- Inspection of efficiency of polluted environmental protection system;
- Release of pollutants or chemical substances and environmental inspection; and
- Other information as prescribed by the Minister in the Royal Gazette.
However,as of today, there is no announcement regarding types of the factory or pollutants or chemical substances that requires to provide the report, as well as the form of the report set by the Ministry of Industry yet.
In conclusion, thisnew regulation is announced toensure the preservation of environmental quality and the law compliance of the factory. Once the announcement regarding the types of factories and forms to report are announced by the Ministry of Industry and published in the Royal Thai Government Gazette, the specific factory must comply with this regulation.We will follow up and keep you updated information on this regulation.
